This contract is concluded, in accordance with Turkey's Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, between the parties identified below, regarding the service ordered electronically by the Buyer.
SELLER: Feyyaz Emre Dertlioğlu (trading as "Etkinlik Anılarım", sole proprietorship). Email: [email protected]. BUYER: the organizer (consumer) who registers on the site and purchases the package. The Buyer accepts that the account and contact details provided during purchase are accurate.
SELLER: the party offering the digital service package for sale through the site. BUYER (CONSUMER): the natural person who registers on the site and purchases the package for non-commercial, non-professional purposes. SITE: the Seller's website at etkinlikanilarim.com. MEMBER: the organizer who registers on the site and uses the service through it. GUEST: the person who uploads files to the gallery via the QR code shared by the organizer. SERVICE: the digital gallery package that is the subject of the order and is performed electronically. LAW: Turkish Consumer Protection Law No. 6502. REGULATION: the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188).
The subject of this contract is to determine the rights and obligations of the parties, pursuant to Law No. 6502 and the Distance Contracts Regulation, regarding the sale and performance of the digital service package purchased electronically by the Buyer from the Seller's site, whose features and price are stated on the purchase screen and in the Pre-Information Form.
The name of the purchased package, the file count and storage limits it provides, and its total sale price including all taxes consist of the information clearly shown on the purchase screen and in the Pre-Information Form at the time of the order. The price is collected as a one-time charge through the secure infrastructure of iyzico, a payment institution licensed by the Turkish banking regulator (BDDK). Card details are never seen or stored by the Seller. No shipping, delivery or other additional cost is charged to the Buyer beyond the price of the service.
The Buyer declares and undertakes that, when registering on the site and during purchase, they have read and electronically approved the Pre-Information Form covering the essential characteristics of the service, the sale price including all taxes, the payment and performance method and the right of withdrawal. The Buyer is responsible for the accuracy and completeness of the account and contact details provided during the order; the gallery is delivered to the email address in those details. If the Seller cannot perform the service due to force majeure or extraordinary circumstances that make performance impossible, the Seller notifies the Buyer and refunds the amount collected within 14 (fourteen) days.
The service is intangible (digital); there is no shipping or physical delivery, and therefore no delivery fee is charged. As soon as payment is approved, the file and storage limits of the purchased package are assigned electronically and instantly to the Buyer's event and performance begins immediately. When the event ends (either because the Buyer ends it or because the 14-day upload window closes), all uploaded photos and videos are packaged into a single archive file and sent by the following morning to the Buyer's registered email address as a download link valid for 24 hours. The performance period never exceeds the maximum period of 30 (thirty) days set out in the Regulation.
As a rule, the Buyer has the right to withdraw from a distance contract within 14 (fourteen) days of its conclusion, without giving any reason and without paying any penalty. Where the right of withdrawal is available, it is exercised by a clear notice sent to the Seller through the support channel on the site or via the registered email address.
Under Article 15/1-(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be used for services performed instantly in the electronic environment and whose performance has begun with the consumer's consent. As the service in question falls within this scope, by confirming the purchase the Buyer accepts having requested that performance begin immediately and having given consent in the knowledge that there will be no right of withdrawal.
If payment has been collected but the service could not be provided at all for technical reasons, if a duplicate charge has occurred, or if a case exists in which the right of withdrawal can be exercised, the relevant amount is refunded to the Buyer. Refund requests are submitted through the support channel on the site. Approved refunds are returned to the card or payment method used, within the payment institution's processes and in any case within 14 (fourteen) days of the request reaching the Seller. The time for the amount to appear in the Buyer's account may vary depending on their bank.
If the Buyer defaults on a payment made by credit card, they accept that they will be liable to the bank under the credit card agreement between themselves and the card-issuing bank. If the payment is for any reason not completed or is subsequently cancelled by the bank or the payment institution, the Seller's obligation to perform the service ends and the assigned package limits may be revoked.
For disputes arising from this contract, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence or at the place where the transaction was carried out are competent, within the monetary limits announced annually by the Turkish Ministry of Trade. Before making such an application, the Buyer may contact the Seller through the support channel on the site for a resolution.
This contract, consisting of 12 (twelve) articles, enters into force after it has been read and accepted electronically by the Buyer and the order has been confirmed by the Seller. A copy of the contract is sent to the Buyer's registered email address and is kept accessible at all times through the site.
